Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE OF DUOMO INC SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES

• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE OUR PRODUCTS

• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA

• DAMAGES ARISING FROM THIRD-PARTY CONDUCT OR CONTENT

Our total liability for any claim arising from or related to our products or services shall not exceed the amount you paid to House of Duomo Inc in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless House of Duomo Inc and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from:

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and House of Duomo Inc and supersede all prior agreements and understandings.

The following terms apply specifically to physical products sold by House of Duomo Inc, including but not limited to clothing, apparel, accessories, custom garments, and any other tangible goods.

Orders and Payment

• All orders are subject to acceptance and availability

• Prices are listed in USD unless otherwise specified

• We reserve the right to refuse or cancel any order for any reason

• Payment must be received in full before orders are processed

• We accept major credit cards and other payment methods as displayed at checkout

Product Descriptions and Images

We make every effort to display our products accurately. However:

• Colors may vary slightly due to monitor settings and photography

• Measurements are approximate and may vary slightly

• Minor variations in handmade or custom items are normal and not defects​

Digital Products (Software Applications, Widgets, and Downloads)

The following terms apply specifically to digital products offered by House of Duomo Inc, including but not limited to software applications, Wix apps, widgets, plugins, templates, digital downloads, and any future digital offerings.

Current Digital Products

These terms apply to the following applications and any future digital products we release:

• CursorPlus - Image magnifier widget for Wix websites

• chatplus - all in one ai platform

• Clio Catch - Form-to-CRM integration for Wix websites and clio legal sofware

• Any additional applications, widgets, or digital products released under House of Duomo Inc

 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use our digital products on your website(s) or platform(s) in accordance with these Terms, the applicable subscription plan, and any platform-specific policies (such as Wix App Market terms).

Permitted Use

You may use our digital products to:

• Add functionality to your website(s) as intended by the product

• Customize the appearance and behavior within provided options

• Connect products to your data sources and integrations as supported

• Use products for personal or commercial websites

Prohibited Use

You may NOT:

​

• Reverse engineer, decompile, or disassemble any digital product

• Copy, modify, or distribute the source code

• Remove or alter any proprietary notices, labels, or branding

• Use products for any unlawful purpose

• Resell, sublicense, or redistribute products as standalone offerings

• Use products to display illegal, harmful, or infringing content

• Attempt to circumvent any licensing, usage limits, or security measures

• Share login credentials or access with unauthorized users

• Use products in a manner that violates platform terms of service

Subscription Plans and Pricing

• Digital products may be offered as free, freemium, or paid subscriptions

• Pricing and features for each plan are listed on the respective product page or app marketplace

• We reserve the right to change pricing with reasonable notice

• Subscription renewals occur automatically unless cancelled

• No refunds are provided for partial subscription periods

• Data loss or errors caused by third-party services

• Third-party service fees or charges

• We are not responsible for data breaches caused by your actions or third-party services

• Free trials, where offered, allow you to evaluate products before purchase

• Refund requests must be submitted within 14 days of purchase

Part IV: Services (Design, Consulting, and Professional Services)

The following terms apply to any professional services offered by House of Duomo Inc, including but not limited to design services, consulting, custom development, and commissioned work.

Scope of Services

• Changes to scope may require additional fees and timeline adjustments

• We reserve the right to decline service requests at our discretion

Fees and Payment

• Service fees are quoted in advance and outlined in writing

• A deposit may be required before work begins

• Final payment is due upon completion unless otherwise agreed

• Late payments may incur interest charges and suspension of services

Client Responsibilities

You agree to:

• Provide timely feedback, approvals, and materials as needed

• Respond to communications within reasonable timeframes

• Provide accurate information and requirements

• Pay all fees according to agreed terms

Deliverables and Ownership

​

• Ownership of deliverables transfers upon full payment unless otherwise agreed

• We retain the right to display completed work in our portfolio unless confidentiality is agreed in writing

• We retain ownership of all preliminary concepts, drafts, and materials not included in final deliverables

Service Cancellation

• You may cancel services with written notice

• Deposits are non-refundable

• You are responsible for payment of all work completed up to cancellation

• We may cancel services if you breach these Terms or fail to meet your responsibilities
